So, right now I'm averaging latency of 1200 to 1500 regardless of time or location in the matrix. I know what the main issues us. One of my roomates is SUCKING UP massive amounts of bandwith. I unplugged everyone but myself from the modem today, and my speeds were:
1353 down
462 Up
I plugged everyone else in again and tested it again:
659 down
40 up
Needless to say, thats a huge difference. Its gotten so bad that even web pages dont load well. Short of unplugging him everytime I want to get in game, can anyone come up with an idea as to how I can fix this? I am prepared to load some kind of software on his computer to subversively limit his bandwith. Or is there something I can use from my computer? I've tried asking him to stop and he insists that he's not downloading anything. My latency in game drops down to below 600 if I unplug just him and leave the other 7 computers connected. If I cant get this problem fixed, I cant afford to stay in game. Everytime I log in I cant move or acomplish much of anything. Any help would be REALL appreciated. Again, dirty or underhanded tactics are more than welcome.

Ask him to maybe reformat his computer if he insists that nothing is being downloaded. He might have gotten some virus that likes to hog bandwidth, but there is definitely something that is sucking up all your bandwidth, so you might want to search on his computer before formatting for possible clues.

Ana beat me to it... if hes really not downloading anything then hes got an uber worm... :p
Theres a program called NetLimiter (i think its v2) that you can use to prove to him that his computer is doing some downloading... and better yet, remotely set limits on his machine. (Looks like you'd need the pro version which would likely require a crack or something, I've not used the software, but it looks really cool!)

Oh, should have been more clear... I know for a fact he's downloading, but he refuses to stop, so he claims he's not downloading naything... but I've seen the bearshare icon in his program tray.

He uses P2P software to download entire television series (not seasons, SERIES). Heironymus can back me up on this one (heir used to live with the guy). He downloaded the entire series of smallville for almost a month. Our internet sucked constantly.

Check to make sure its not his uploads as well. I have the same issue in my fraternity. I found uploads were killing our connection(since everything defaults to unlimited upload bandwith).

3. I'm willing to load anything on his computer or get in his face a little bit, but he was a marine sniper for many years, and I'd rather not actually start anything with him. He's not very computer literate so it shouldn't be hard to hide anything on his computer.

First of all, never ask anyone to reformat their computer. I HATE that. "Hey guys, I'm having a problem with this and that". "Err..reformat". Sigh...sometimes there are solutions that are less extreme than pressing the big red reset button.
To address your problem, do you have access to the router settings? If so, you could probably limit his port connections to where basically all he can do is surf the web. If he complains, just tell him you thought he wasn't downloading anything anyway and that you are having the same problem and that the internet company is probably blocking something.

How would I go about doing that? I like the idea of limiting his port connections, but I'm not really sure how to do that. How do I find out if I have access to the router settings

If you have a wireless router, which computer is plugged directly into the LAN line of the router? Or which computer is the one that you used to set up the router? That computer is the one with access, via an IP address. Just type the address into the browser. I think most routers are set to 192.168.1.1 but I could be wrong. You can also set up remote access once you get in if you want to work through your computer. If you have the documentation, check it for specifics. The router I use has "admin" as the default username and nothing as the password, so if it asks for login information, try that.
After you get into the router, check for the settings that show the different computers logged into the router (each computer should have its own network IP.) Since you are logged on as the admin of the router, you can set the security settings for these different accounts. There should be a way to do it individually. Do a google search and find out which ports Bearshare uses and block those. If he doesn't use the computer for much anything else, you could probably get away with blocking most ports except 80 (the HTTP port).

I'm having trouble getting this. I put the ip adress you said into my browser and I get a "Problem Loading Page" error. I checked with Linksys and that address is correct. I tried disabling my firewall, but still no luck. Any ideas?

And you are using the computer that is plugged into LAN1?

The problem is that he is at a house where the main internet cable goes straight into his room.. the router is in his room.. then it splits into 4 cables, each going to different rooms through the ceiling.... the router is in his room so. theoretically.. he ha ultimate control... he could unplug everyone.. lock the door and leave.. and only one other person has the key to his room besides me (I am a renter that doesn't live there ;) ) ... but.. the longer it takes him to download said movies the more that he puts on the download que...

To find your default gateway address:
Start--> Run... cmd
ipconfig
The default gateway should be listed there for your ethernet adapter, if you type that into your browser do you get an admin page?
I don't know how much control you are going to have with that firewall, because the unit is actually a gateway, rather than a router.

I have managed to get to the username and password, but nothing seems to work. And since I installed the damn thing and never set up a password, I'm a bit confused.

Is it possible that its been auto configured by the ISP? I know it doesn't make much sence but you never know...
